"User" means an account owner who offers services on the platform and identifies as a freelancer.
“Client" refers to the hiring body in search of freelance services from whom payments and compensations shall be sent.
"Freelancer", "we", "our", "company" or "the company" or “the platform” or "us" refers to Apply4Gigs.
"Apply4Gigs" provides freelancers access to jobs and immediate employment. Apply4Gigs enables freelancers to scale up their careers and earning potentials.
"Verified by Apply4Gigs" is received by freelancers who have been satisfactorily verified under the Identity Verification and Know your Customer Policy.
"Inactive Account" a User's Account is deemed inactive if it has not been logged into for 6 months (or more/less determined by us).
"Intellectual Property Rights" refers to patents, copyright, registered designs, registered and unregistered trademarks, any right to have confidential information kept confidential, and any similar rights.
"Local Job" or "Local Jobs" is used concerning the provision of location-specific services.
"Project" or "Listing" means a job offered by the client via the Website.
"Freelance Services" means all services provided by a freelancer.
"User", "you" or "your" means an individual who visits or uses the Website and identifies as a freelancer.
"User Contract" means this document (User Agreement) and any other contractual provisions, accepted by both the Freelancer and the Client, and uploaded to the Website.
"Website" means the official website operated by Apply4Gigs and any of its subdomains, and any related Apply4Giggs service, tool, or application, including mobile web, any iOS App, and any Android App, or API, or other tools for access.
1. Overview
By accessing the Website, you agree to the following terms with apply4Gigs.
We reserve the right to change this User Agreement and any related information at any time by publishing revised terms on the Website without prior notification to you.
The Website serves as a platform for Freelancers to connect with their clients. To use our services, freelancers must first create an account.
We reserve the right to change or add to the Website, as well as the information, products, or services described on it, at any time and without notice. However, we do not commit to keeping the Website up to date. If there is an error in the information on the Website or if the information is not current, we are not accountable to you or anyone else.
2. Scope
Any provisions in this User Agreement, the Apply4Gigs Privacy Policy, and all Website policies must be read and accepted. By accepting this User Agreement as you access our Website, you agree that it will apply to you anytime you use the Website or the tools we provide to interact with the Website.
3. Using Apply4Gigs
You will not use the Website if you:
1. are not able to agree to legally binding contracts
2. are below 16 years of age
3. are unable to offer services under the laws of Nigeria, America, or any other applicable jurisdiction
4. have been banned from using the Website for whatever reasons
5. do not own a valid email address
Users should not share their login details with others. The person linked with the account will be held liable for all activities made by the account.
Without our prior written consent, you may not transfer or assign any of your rights or duties under this agreement.
4. Intellectual Property Rights Infringement
Our policy is to respond to notices of an alleged infringement of intellectual property rights. Please report to us promptly on our Website if you believe your Intellectual Property Rights have been violated, and we will investigate.
5. Payment Administration Agent
You agree and understand that we may appoint any third party to accept or make payments on our behalf to Users or (or from Users) from time to time.
6. Promotion
You understand and accept that the content of your profile information and the public description of your Projects on the Website may be used for marketing and other intents.
7. Content
We do not claim ownership of your User Content; however, you grant us a non-exclusive, royalty-free, and irrevocable license to use such User Content in all media
forms now established or hereafter created, without asking you or any other entity for permission and without remuneration.
The Website's content may provide general information on diverse topics. This is not intended to be taken as advice and should not be regarded as such. You should not use the information on the Website to replace professional advice. If you have any specific questions, you should speak with a professional adviser.
8. Identity / Know Your Customer
You authorize us to make any inquiries we consider necessary to validate your identity. You must provide further information to us at our request. This may include your date of birth and other information that will allow us to identify you.
You must also provide copies of identification documents (such as your passport or driver's license) at our request.
9. Disputes With Users
You acknowledge and agree that if a dispute arises between you and another User concerning any Project that you will first attempt to resolve any differences that you have concerning such Project.
If you continue to have any difficulties or problems concerning a dispute with another User concerning a Project we encourage you to contact us.
10. Disputes With Us
If a dispute arises between you and Apply4Gigs, our goal is to address your concerns immediately and, if we are unable to do so satisfactorily, we will provide you with a means of resolving the dispute quickly.
11. Survival and Release
This agreement supersedes any other agreement between you and the Company. If any part of this document is deemed unenforceable, that part will be limited to the minimum extent necessary so that this document will otherwise remain in full force and effect.
12. Access and Interference
You agree that you will not use any automated procedure to access the Website through any means for any intent without our express written permission.
13. Closing Your Account
You may close your Account at any time by visiting your account settings.
We may retain some of your personal information. Closing your account does not technically delete or erase all of the information we reserve.
14. Privacy
We use your information as described in the Apply4Gigs Privacy Policy. You must not use our services if you object to your information being transferred or used in this way.
15. Security
You must immediately notify us when made aware of any unauthorized access or any other security breach to the Website or your Account and do everything possible to curtail the breach (including preserving evidence and notifying appropriate authorities).
Your User Account is yours only, and you must not divulge your login details to others. You are solely responsible for securing your password. We will not be liable for any loss or damage arising from unapproved access to your account resulting from your negligence to secure your password.
16. Interpretation
Headings in this document are for referral purposes only. They do not define or describe the scope of a section.
17. No Waiver
Our failure to act to a breach by you or others does not waive our right to act concerning subsequent breaches. Nothing excludes or restricts your liability arising out of fraud or fraudulent misrepresentation.
